Privacy policy

Translation for information only; the German version is legally binding. German version

1. Privacy at a glance

This website is largely a read-only presentation. It contains no tracking pixels, no advertising networks and no social media buttons. The only forms are the self-assessments for business advisory and for AI & Automation; what happens to your details there, and which cookie our partner links set, is described in section 7. Fonts and images are hosted on the same server as the site itself, so no connection to a third-party provider is made when you visit. If you only read this site, no data about you is created apart from the technically necessary server logs.

2. Controller

Clairmont Advisory and Partners L.L.C-FZ
Meydan Grandstand, 6th floor
Meydan Road, Nad Al Sheba
Dubai, U.A.E.
P.O. Box: 9305

Managing director authorised to represent: Erol Emre Kolukisa
E-mail: info@clairmont-advisory.com

The controller is the natural or legal person who alone or jointly with others determines the purposes and means of the processing of personal data.

3. Server logs

When you access this site, the web server briefly stores, for technical operation, the transmitted internet address of your connection, the time of access, the address requested, the referring page and details of your browser and operating system. This data is needed to deliver the site and to ward off attacks. The legal basis is Article 6(1)(f) GDPR; our legitimate interest is secure and trouble-free operation. This data is not merged with other sources.

4. SSL/TLS encryption

For security reasons and to protect the transmission of confidential content, this site uses SSL/TLS encryption. You can recognise an encrypted connection by the browser address line changing from "http://" to "https://" and by the padlock symbol in your browser bar. When encryption is activated, the data you transmit to us cannot be read by third parties.

5. Contact by e-mail

If you write us an e-mail, we process your details to handle your request and in case of follow-up questions. The legal basis is Article 6(1)(b) GDPR insofar as your enquiry is aimed at a contract, otherwise Article 6(1)(f) GDPR based on our legitimate interest in responding. We do not pass this data on without your consent.

6. Forecast and client account

The free forecast and the client account are not on this website but on a separate system at app.clairmont-advisory.com. Separate privacy notices apply there and are shown to you before you submit your details. Only when you enter something there is personal data processed for the tax return. Merely opening this website does not trigger such processing.

7. Self-assessments and partner links

Via the pages Business advisory and AI & Automation you can send us a self-assessment about your company. We process the details you enter. For business advisory these are the company name, first and last name, e-mail address and phone number of the contact person, your answers on business, customers, employees, revenue, profit, costs, liabilities and goals, the desired scope and any documents you voluntarily attach, such as a management report or presentation. For AI & Automation these are the company name, first and last name, your role if you wish, e-mail address and phone number, your selection on industry, number of employees, tasks, salary range, share of routine work, need for action, software in use and special requirements for your data, as well as the preferred contact channel and the best time for a call back.

The purpose is to assess your company, to contact you and to prepare an offer for you. The legal basis is Article 6(1)(b) GDPR, because you are thereby requesting steps prior to entering into a contract with us. We need your contact details and the mandatory questions for this; without them we cannot get back to you. All other details are voluntary. The estimate at the end of the AI & Automation self-assessment is calculated from your details; it is a non-binding guide and not a decision about you.

Your self-assessment goes directly into our customer management system on our own server at Hetzner Online GmbH, Gunzenhausen, in a data centre in Germany. Attached files are checked for viruses there. We send the confirmation to you and the notifications to our team via our own mail server, also at Hetzner in Germany. Hetzner processes the data only on our instructions on the basis of a data processing agreement under Article 28 GDPR. If you came to us via the link of a Clairmont sales partner or entered a partner code, this sales partner can see your enquiry in order to look after you together with us.

Our sales partners use their own links so that we can assign an enquiry to the right partner. If you open such a link, your browser stores the cookie “clairmont_link” for one year. It contains only a random partner identifier, no information about you, and is read by our forms when you later submit an enquiry. You can delete the cookie at any time in your browser settings; your enquiry will then not be assigned to a partner. For the assignment to the partner we rely on Article 6(1)(f) GDPR; our legitimate interest is correct settlement with our sales partners.

While you fill in a form, your browser stores a draft of your entries locally on your device so that nothing is lost. This draft is not transmitted to us and is deleted after submission. To protect against automated submissions, we check how long filling in took and limit the number of submissions per internet address. For this we store the internet address together with the submission (Article 6(1)(f) GDPR; the legitimate interest is protection against misuse).

If no contract is concluded, we delete your self-disclosure no later than six months after receipt. If a contract is concluded, we keep it for the duration of the collaboration and afterwards within the statutory retention periods.

8. Transfer to a third country

The controller is based in the United Arab Emirates, i.e. outside the European Union. Insofar as you transmit data to us, it is processed there. There is no adequacy decision of the European Commission under Article 45 GDPR for the United Arab Emirates. The transfer therefore takes place on the basis of Article 49(1)(b) GDPR where it is necessary for the performance of a contract with you, or on the basis of your explicit consent under Article 49(1)(a) GDPR.

9. Your rights as a data subject

You have the right at any time to free information about your stored personal data, its origin and recipients and the purpose of the processing. You also have a right to rectification, erasure or restriction of processing, a right to data portability and a right to object. You can withdraw consent you have given at any time with effect for the future. For this and for further questions about data protection you can contact us at any time. You also have the right to lodge a complaint with a data protection supervisory authority.

10. Retention period

Unless a more specific retention period is stated in this privacy policy, your personal data remains with us until the purpose for the data processing no longer applies. If you assert a legitimate request for erasure or withdraw consent to data processing, your data will be deleted unless we have other legally permissible reasons for storing your personal data, for example retention periods under tax or commercial law. In the latter case, deletion takes place once these reasons cease to apply. Server logs are deleted after seven days at the latest.

11. Contact for data protection questions

For questions about data protection you can reach us at info@clairmont-advisory.com.
